Texas Real Estate Sales Forms & Contracts
If you are buying or selling a home yourself and are looking for a form or contract, the Texas Real Estate Commission has contracts available free in pdf format to the public. They are the same or similar to those used by licensed Realtors®. Below are the most common and if you need any other forms or contracts, let me know. There are additional forms available to Realtors® and in some cases, an Attorney is needed.

- Unimproved Property Contract
For lot and land sales. - Residential Condominium Contract (Resale)
Condos have additional details related to sales that this form includes. - Condominium Resale Certificate
- One to Four Family Residential Contract (Resale) *
Most commonly used form. Applies to nearly all residential home resales.
- Third Party Financing Addendum for Credit Approval *
When a transaction will be subject to financing approval. - Addendum for Sale of Other Property by Buyer
If furniture or other “non-fixture” items are to be included in a real estate transaction. - Addendum for “Back-Up” Contract
- Addendum for Release of Liability on Assumed Loan and/or Restoration of Seller’s VA Entitlement
- Seller’s Temporary Residential Lease
For use when Sellers will be leasing the property back after the sale. - Buyer’s Temporary Residential Lease
For use when Buyers will be moving in before the sale closes.
- Addendum for Property Subject to Mandatory Membership in an Owners’ Association
Use when a property is in a Home Owner’s Association, not to be confused with a Neighborhood Association (which does not need a form). - Subdivision Information, Including Resale Certificate for Property Subject to Membership in a Property Owners’ Association
- Notice of Buyer’s Termination of Contract
When a Buyer needs to terminate a contract either in or past an Option Period. Option Fee will be forfeited, Earnest Money may be refundable. - Amendment to Contract *
To change many contract details including sales price (including repair allowances), closing date, and special provisions. - Lead-Based Paint Addendum
Required for the sale of any property built prior to 1978. - New Home Contract (Incomplete Construction)
For new homes that have been started but will close before completion. Builders who are members of the Home Builder’s Association of Greater Austin have a similar form with additional Addenda. - New Home Contract (Completed Construction)
For speculative homes that have been completed and are ready for move-in. Builders who are members of the Home Builder’s Association of Greater Austin have a similar form with additional Addenda. - Farm and Ranch Contract
Includes details related to farms & ranches including additional buildings and structures. - Seller Financing Addendum
We always advise to see an attorney when dealing with Seller financing, but in a pinch, use this form. - Loan Assumption Addendum
Not all loans are assumable. Check with the lender first. - Short Sale Addendum
For use when the lender approves a sale below the amount owed on the loan. Check with lender first. - Seller’s Disclosure of Property Condition *
